Terms of Service

Acceptance

These Terms of Service (“Terms”) are an agreement between you and NewFamiliar Corp, a Delaware corporation (“Ghost”, “we”, “us”), governing your use of the Ghost application and services. By creating an account or using Ghost, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Ghost.

The service and your account

Ghost provides tools to create, generate, manage, and publish content across connected platforms. You must be at least 18 years old and able to form a binding contract to use Ghost. You are responsible for the activity under your account and for keeping access to your email secure, since we use it to sign you in.

Subscriptions, trials, and billing

Paid plans are billed through our payment processor, Stripe, on a recurring basis (monthly or annual, as selected) until cancelled. Introductory or founding pricing applies only as described at the time of purchase and may change for future terms. Any free trial converts to a paid subscription unless you cancel before it ends.

You can cancel at any time from your billing settings or the customer portal; cancellation takes effect at the end of the current billing period, and you retain access until then. Except where required by law, payments are non-refundable. We may change our prices or plans on a prospective basis with notice.

Your content and ownership

You retain all rights to the content you create, upload, or generate in Ghost (“Your Content”). You grant us a limited license to host, process, and transmit Your Content solely to operate and provide the service to you, including sending it to the AI and infrastructure providers described in our Privacy Policy. We do not use Your Content to train our own AI models, and we do not sell it.

You are responsible for Your Content and for ensuring you have the rights to use it. You must not use Ghost to create or publish content that is unlawful, infringing, deceptive, harassing, or that violates the rights of others.

AI-generated output

Ghost generates content using AI. AI output can be inaccurate, incomplete, or unsuitable for your purpose, and similar output may be generated for others. You are responsible for reviewing, editing, and verifying any output before you rely on it or publish it. We make no warranty that AI output is accurate, original, or fit for a particular purpose.

Connected platforms

When you connect a third-party account (such as LinkedIn, X/Twitter, Facebook, or Bluesky), you authorize us to act on your behalf to publish and retrieve content as you direct. Your use of those platforms remains subject to their own terms, and you are responsible for complying with them. We are not responsible for the availability or actions of any third-party platform, and a platform may change or revoke access at any time.

Acceptable use

You agree not to misuse Ghost, including by attempting to access it without authorization, interfering with its operation, reselling or reverse-engineering it, exceeding plan limits through automated means, or using it to violate any law or the rights of others. We may suspend or limit accounts that we reasonably believe violate these Terms.

Our intellectual property

Ghost, including its software, design, and trademarks, is owned by NewFamiliar Corp and protected by law. These Terms do not grant you any right to our intellectual property except the limited right to use the service in accordance with these Terms.

Termination

You may stop using Ghost and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we are required to by law. On termination, your right to use the service ends; sections that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will continue to apply.

Disclaimers

Ghost is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, NewFamiliar Corp will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of Ghost. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless NewFamiliar Corp from any claims, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the service, or your violation of these Terms or the rights of any third party.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to their jurisdiction and venue.

Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you. Your continued use of Ghost after an update means you accept the revised Terms.
